Banking regulators issued final regulations—with a mandatory compliance date of November 1, 2008—to implement Section 114 and 315 of the Fair and Accurate Credit Transactions (FACT) Act.

There are three new regulations. The focus of the Red Flags Resource Center is on the regulation that requires financial institutions or creditors to develop and implement an Identity Theft Prevention Program in connection with both new and existing accounts. To comply with the FACT Act Red Flags regulations, the identity theft program must include reasonable policies and procedures for detecting, preventing, and mitigating identity theft.
